1. Agreement to Terms

By accessing or using Superdegree ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Superdegree is an AI-powered visual content generation platform that enables users to create professional presentation slides, animated videos, and audio narrations. Our Service uses multiple artificial intelligence technologies to:

• Generate presentation slides from text topics, YouTube URLs, or uploaded files
• Create AI-generated images in multiple quality tiers (2K and 4K)
• Produce animated videos from static images using AI animation models
• Generate text-to-speech audio narrations with word-level timestamps
• Edit and enhance images using AI-powered tools
• Export presentations in multiple formats (PNG, JPEG, PDF)
• Organize content into projects and make slides discoverable to the public

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use
• Be responsible for all activities that occur under your account

3.2 Account Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. User Content and Intellectual Property

4.1 Your Content

You retain all rights to any content you submit, upload, or create using our Service ("User Content"), including text prompts, uploaded files, YouTube URLs, logos, style reference images, and custom formatting preferences. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, process, store, and display your content to provide the Service
• Process your content through third-party AI services to generate slides, images, videos, and audio
• Create derivative works (slides, images, videos, audio) based on your inputs
• Display your content publicly if you mark slides as "discoverable"

This license ends when you delete your content or account, except for content that has been shared publicly or is required for legal retention.

4.2 AI-Generated Content

Content generated by our AI technology based on your inputs (including AI-generated slides, images, videos, and audio) is provided to you under a non-exclusive, worldwide license. You may use AI-generated content for:

• Personal use
• Educational purposes
• Commercial purposes (presentations, marketing materials, etc.)

Important: AI-generated content may be subject to the intellectual property policies of our AI service providers. You are responsible for ensuring your use complies with applicable laws and third-party terms. We do not guarantee that AI-generated content is free from third-party intellectual property claims.

4.3 Discoverable Content

You may choose to make slides "discoverable," which makes them publicly visible on our platform. By marking content as discoverable, you grant other users a non-exclusive license to view that content. You can revoke discoverability at any time through your account settings.

4.4 Content Restrictions

You agree not to upload or create content that:

• Violates any intellectual property rights (including unauthorized use of copyrighted videos, images, or text)
• Contains malware, viruses, or malicious code
• Is illegal, harmful, threatening, abusive, harassing, defamatory, or offensive
• Violates anyone's privacy or publicity rights
• Contains false or misleading information
• Depicts or promotes violence, illegal activities, or self-harm
• Contains adult content, nudity, or sexually explicit material
• Infringes on trademarks or brand identity without authorization
• Violates any applicable laws or regulations

We reserve the right to remove any content that violates these restrictions or our policies, and to suspend or terminate accounts that repeatedly violate these terms.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any proprietary notices or labels
• Impersonate any person or entity
• Sell, resell, or commercially exploit the Service without authorization

6. Payments and Credit System

6.1 Credit-Based Pricing

Our Service operates on a credit-based system. All features require credits to use. Credits are purchased through our platform using a secure payment processor. All prices are listed in USD and are subject to change with reasonable notice.

Credit Purchase Rates: 100 credits = $1 USD

• Minimum purchase: $1 (100 credits)
• Maximum purchase: $1,000 (100,000 credits)

6.2 Credit Usage Costs

Credits are consumed when you use the following features:

• Slide Generation: 75 credits per slide deck
• Audio Generation (TTS): 25 credits per audio narration
• Image Edit (AI-powered): 10 credits per edit operation
• Video Generation (2K): 40 credits per video
• Per-slide Video Animation: 30 credits base (20 credits for ≤4 seconds, plus 5 credits per additional second)

Credit costs are subject to change. We will notify users of significant pricing changes. Changes do not affect credits already purchased.

6.3 Payment Processing

By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for all charges incurred under your account. We use a secure payment processor and do not store your credit card details.

6.4 Credit Deduction and Task Failures

Credits are deducted when a generation task (slide, audio, video) is initiated. If a task fails due to a system error or service issue, credits may be refunded at our discretion. Credits are not refunded for:

• User errors in prompts or inputs
• Content that violates our policies
• Tasks that complete successfully but do not meet user expectations

6.5 Refunds

Credit purchases are generally non-refundable except as required by law or at our sole discretion. We may issue refunds in the following circumstances:

• Duplicate charges or billing errors
• Significant service outages preventing credit usage
• Within 7 days of purchase if no credits have been used

Contact us at support@learnpte.com if you believe you are entitled to a refund. Refund requests must be made within 30 days of the original purchase.

6.6 Credit Properties

• No Expiration: Credits do not expire and remain in your account indefinitely
• Non-Transferable: Credits cannot be transferred to other accounts or sold to third parties
• No Cash Value: Credits have no cash value and cannot be redeemed for money
• Forfeiture on Termination: Unused credits are forfeited if your account is terminated or deleted

6.7 Transaction History

All credit purchases and usage are tracked in your account. You can view your transaction history, including credit purchases, deductions, and balance, through your account dashboard.

7. AI Technology and Limitations

Our Service uses multiple artificial intelligence technologies from various providers. AI technology has inherent limitations and uncertainties:

• Accuracy: AI-generated content (images, text, audio, video) may contain errors, inaccuracies, or inconsistencies
• Unpredictability: AI outputs may vary and produce unexpected results even with similar inputs
• Factual Errors: Generated content may include incorrect information, outdated data, or fabricated details
• Bias: AI models may reflect biases present in their training data
• Copyright Concerns: AI-generated content may inadvertently resemble existing copyrighted works
• Quality Variations: Output quality may vary based on input quality, complexity, and AI service availability
• Processing Time: Generation tasks are processed asynchronously and may take several minutes to complete
• Service Dependencies: Our Service depends on third-party AI providers, and their availability affects our Service

YOU ARE RESPONSIBLE FOR REVIEWING AND VALIDATING ALL AI-GENERATED CONTENT BEFORE USE. We do not guarantee the accuracy, completeness, reliability, quality, or suitability of AI-generated content for any particular purpose.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Third-Party Services

Our Service integrates with and depends on multiple third-party services. Your use of our Service constitutes acceptance that your content will be processed by these third-party services:

9.1 AI Service Providers

We integrate with multiple AI service providers that process your content to generate slides, images, videos, and audio narrations. These services are provided by reputable AI technology companies.

9.2 Infrastructure Services

We use various infrastructure providers including:

• Database and authentication provider (hosting, authentication, file storage)
• Background job processing service (async task orchestration)
• Payment processing provider (secure payment handling)
• Analytics service (product analytics and insights)

9.3 Third-Party Terms and Policies

Your use of these third-party services through our platform is subject to their respective terms of service, privacy policies, and acceptable use policies. We are not responsible for:

• The actions, policies, or practices of third-party services
• Service interruptions or failures caused by third-party providers
• Changes to third-party terms, pricing, or availability
• Data handling practices of third-party services
• Quality or accuracy of third-party AI outputs

We make reasonable efforts to work with reputable service providers, but we cannot guarantee their performance or availability. Service disruptions caused by third-party providers may affect our ability to provide the Service.

10. Disclaimers and Limitations of Liability

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

10.2 General Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, sales, business, revenue, anticipated savings, goodwill, or reputation
• Loss, corruption, or unavailability of data, files, or content
• Business interruption or loss of business opportunity
• Any indirect, consequential, special, or incidental damages of any kind

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.3 Security and Harmful Content

WE DO NOT WARRANT THAT THE SERVICE WILL BE FREE FROM VIRUSES, MALWARE, WORMS, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS. We are not liable for damage caused by distributed denial-of-service attacks, viruses, or other technologically harmful material. You are responsible for:

• Implementing virus checks and security measures to protect your systems
• Scanning all downloaded content for malicious code
• Maintaining secure IT infrastructure and devices
• Maintaining external backups and means for data reconstruction

10.4 User Responsibilities

You are solely responsible for:

• Maintaining backup copies of your content - do not rely solely on our Service for storage
• Regularly exporting and saving generated content to your own storage
• All claims related to User Content you upload, including copyright, defamation, or privacy violations
• Ensuring your use of AI-generated content complies with applicable laws and third-party terms
• Reviewing and validating all AI-generated content before use

10.5 Third-Party Dependencies

We are not liable for issues arising from third-party service providers, including:

• Service interruptions, failures, or changes in availability
• Quality, accuracy, or appropriateness of outputs from AI providers
• Data handling practices or security breaches of third parties
• Changes to third-party pricing, terms, or policies that affect our Service

10.6 Force Majeure

We are not liable for failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, civil unrest, natural disasters, pandemics, strikes, or failures of third-party service providers, internet service providers, or telecommunications networks.

10.7 Jurisdictional Limitations

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Superdegree and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

12.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion:

• Your access to the Service will immediately cease
• Your content will be marked for deletion (soft delete with recovery period)
• Unused credits will be forfeited with no refund
• Transaction history will be retained for legal and accounting purposes
• Public discoverable content may be retained for a reasonable period

12.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of content restrictions or acceptable use policies
• Fraudulent activity or payment disputes
• Abuse of the Service or disruption to other users
• Legal or regulatory requirements
• Extended period of inactivity

12.3 Effect of Termination

Upon termination by either party:

• All licenses granted to you under these Terms will immediately terminate
• You must cease all use of the Service
• Provisions that by their nature should survive termination will survive (including payment obligations, disclaimers, limitations of liability, and dispute resolution)
• We may permanently delete your content after a reasonable retention period

13. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are owned by Superdegree and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Export and Data Portability

You may export your generated content at any time using our export features:

• Export slides as PNG, JPEG, or PDF formats
• Download individual images, videos, and audio files
• Access your content through your account while it remains active

19. Australian Consumer Law

For Australian users, nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable laws that cannot be excluded, restricted, or modified by agreement. To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited, at our option, to:

• Re-supplying the services; or
• Paying the cost of having the services re-supplied
